The children had a sad childhood at least since 2019, when the older girl was six years old and the second only one year old. “In their presence, the defendants overused alcoholic beverages and narcotic substances, looked after the children in unsatisfactory hygienic conditions and exposed them to conflict situations arising mainly from mutual coexistence,” the indictment stated.
“The children were repeatedly present during their vulgar verbal conflicts and mutual physical attacks, during which the police patrol intervened. The defendants were repeatedly under the influence of alcohol and were unable to take care of the children in this state,” added the public prosecutor’s office, adding that the mother also went to the store with the children, stole and was caught stealing.
The successful couple was already sent to prison for 18 months by the Municipal Court in Brno, which also ordered the older girl to pay 20,000 crowns and the younger one 15,000 crowns. However, the children’s representative filed an appeal against this, and the case went to the Brno Regional Court.
The compensation is only symbolic
“Both children were exposed to the criminal behavior of the defendants, who were the closest people to them, from an early age. Such negotiations lasted several years and were clearly able to influence their further development. The awarded amount is disproportionately low and does not reflect the evidence situation. Even so, we are only asking for symbolic compensation,” declared the representative, who wanted thirty thousand crowns for each of the children.

While the man’s lawyer simply rejected an increase in compensation, the mother’s lawyer started moralistic musings. “The client is trying to fulfill her obligations so that she can be released soon, be with her children and behave like a proper citizen of this state,” the defense attorney said.
The senate, with judge-rapporteur Mária Petrovková, granted the attorney’s appeal and granted the children the claimed amount. “Given what the children had to endure, the claim is really symbolic and there was no reason for the trial court to reduce it. The children were exposed to the behavior from their closest relatives, who were supposed to protect and care for them,” the judge stated.
“The younger girl was not able to understand the situation sufficiently, she felt completely helpless, she was more vulnerable, she also needed more care. The older one started going to elementary school at that time, and she developed the abused child syndrome. Both had to suffer like this for several years. There is no reason for them to receive other amounts,” added the judge.
Unfortunately for the children, the case meant not only severe scars on their souls, but also their division. The older sister is in the care of her father and the other is with her grandmother.
