OpenAI claims that they have managed to resolve or explain all the issues identified by the authority so that they can resume ChatGPT operations. Italy’s data protection authority claimed that “OpenAI collects personal data without any legal basis”.
The operator of ChatGPT justified the collection and storage of personal data only by the fact that it is necessary for training the algorithms that are the basis of the operation of the platform. However, shortly before the relaunch of the service in Italy, the ChatGPT chatbot was given an anonymous mode.

Although the introduction of the anonymous mode solves some of the problems, OpenAI’s chief technology officer Mira Murati says that the new feature was not created because of the complaints of the Italian authorities. “We will move more and more in this direction – to prioritize user privacy,” Murati said, according to Reuters.
According to her, the goal is to put users “in the driver’s seat”, at least as far as their accumulated data is concerned.
User age verification
Officials were also bothered by the fact that ChatGPT does not check the age of users in any way. Despite OpenAI’s claims that only people over 13 can use the chatbot, the service’s website did not check the age of users in any way, which is against current legislation.
But OpenAI has submitted a plan to officials on how it will check the age of users.
Authorities in France and Spain have also previously begun investigating the service due to the same concerns.
